Laws and Regulations

Q. Where can I find regulations for preparing and selling food out of my home?

A. Law and regulations for the sale of food prepared in home kitchens are different within each state. For example, some states require home kitchens to be licensed by the local public health department and obtain a food establishment permit, while others require them to be registered rather than licensed. Other states may not even allow the sale of food prepared in home kitchens, and require that it be prepared in a commercial kitchen.

To find the laws in your state visit the State Retail Food Regulations web page available from AFDO

You may also try contacting your State Department of Agriculture or an FDA Small Business Representative in your region.
